What it is
The NDIS Code of Conduct sets out the standards of behaviour expected of everyone who works in the NDIS — both registered and unregistered providers and the individual workers they employ or engage. It is enforced by the NDIS Quality and Safeguards Commission and applies regardless of how a participant’s supports are funded.
The Code translates participant rights into day-to-day conduct. It requires workers to act with respect for individual rights to freedom of expression, self-determination and decision-making, and to respect the privacy of people with disability.
It also requires that supports and services are provided in a safe and competent manner with care and skill, that workers act with integrity, honesty and transparency, and that concerns about the quality or safety of supports are raised and acted on promptly.
Critically, the Code obliges everyone to take all reasonable steps to prevent and respond to violence, exploitation, neglect and abuse, and to prevent and respond to sexual misconduct. Breaches can lead to compliance and enforcement action against the provider and against individual workers.
Key requirements
- Ensure all workers understand and comply with the seven obligations of the Code of Conduct
- Provide induction and ongoing training so workers can recognise and respond to risks
- Embed the Code in your policies, position descriptions and codes of practice
- Maintain systems to receive, manage and act on concerns and complaints promptly
- Take all reasonable steps to prevent and respond to abuse, neglect, violence and sexual misconduct
